WAPPACK LLC (“WAPPACK,” “we,” “us,” or “our”) respects your privacy.

This Privacy Policy explains how we collect, use, store, disclose, and protect information when you:

  • visit or make a purchase through wappack.com and other WAPPACK-operated websites or online stores; or
  • create an account for or use WAPPACK digital products and applications, including RetailCue.

The information we collect and how we use it depends on which WAPPACK service you use.

1. Information We Collect

Website and Online Store Information

When you visit our website or online store, we may automatically collect certain technical information about your device and how you interact with the site, including:

  • IP address;
  • browser type;
  • device information;
  • time zone;
  • pages or products viewed;
  • referring websites or search terms;
  • date and time information; and
  • interactions with our website.

We may collect this information through technologies such as cookies, log files, pixels, tags, and similar technologies.

Order Information

When you make or attempt to make a purchase through our online store, we may collect information such as:

  • name;
  • billing address;
  • shipping address;
  • email address;
  • telephone number;
  • products purchased;
  • transaction details; and
  • payment information necessary to complete the transaction.

Payment-card information is generally processed by our payment and e-commerce providers. WAPPACK may receive transaction information related to your purchase but does not necessarily receive or store your complete payment-card number.

2. How We Use Website and Order Information

We may use website, device, and order information to:

  • process and fulfill orders;
  • arrange shipping or delivery;
  • provide invoices and order confirmations;
  • communicate with customers;
  • provide customer service;
  • detect and prevent fraud, abuse, and security incidents;
  • improve and optimize our websites and online stores;
  • understand how customers interact with our services;
  • maintain our business records;
  • comply with legal obligations; and
  • provide marketing communications where permitted by law and consistent with your preferences.

3. RetailCue Mobile App

RetailCue is a retail decision-support application provided by WAPPACK LLC.

RetailCue allows businesses and retail operators to record store-performance information, review performance metrics, and receive decision-support guidance based on information entered into the application.

Information You Provide Through RetailCue

When you create or use a RetailCue account, we may collect information including:

  • your name;
  • email address;
  • account credentials and account-related information;
  • business or organization name;
  • information associated with your RetailCue workspace; and
  • retail operating information that you choose to enter.

Retail operating information may include:

  • store traffic;
  • transaction counts;
  • gross sales;
  • sales goals;
  • product or category observations;
  • focus areas;
  • customer objections or feedback that you choose to record;
  • merchandising observations;
  • display tests;
  • offer tests;
  • operating notes; and
  • other store or sales-floor context you choose to enter.

RetailCue is intended for business and retail decision support.

Please do not enter sensitive personal information about customers, employees, or other individuals unless you are authorized to provide that information and it is necessary for your use of RetailCue.

How RetailCue Collects Information

RetailCue primarily collects information:

  • when you create or manage your RetailCue account;
  • when you manually enter information into the application;
  • when the application stores information associated with your workspace;
  • when you interact with RetailCue features; and
  • when Apple provides information necessary to verify or manage an App Store subscription.

How RetailCue Uses Information

We use information collected through RetailCue to:

  • create, authenticate, and secure RetailCue accounts;
  • create and maintain business workspaces;
  • save and display information entered by users;
  • calculate and display retail-performance metrics;
  • generate RetailCue decision-support results and Consultant Briefs;
  • provide features associated with Free or Standard subscription access;
  • verify subscription eligibility;
  • restore applicable purchases;
  • support password recovery and account management;
  • provide customer support;
  • maintain the security and reliability of RetailCue;
  • diagnose technical issues;
  • prevent fraud, misuse, or abuse;
  • maintain appropriate business and security records; and
  • comply with applicable legal requirements.

RetailCue provides decision-support information based on the information entered into the application. Results may be incomplete or inaccurate, and users should exercise their own judgment when making important business decisions.

4. RetailCue and Artificial Intelligence

The current version of RetailCue does not send user-entered RetailCue store or business information to third-party generative artificial-intelligence providers such as OpenAI, Anthropic, or Google Gemini.

RetailCue's current Consultant Brief functionality provides decision support based on RetailCue's application logic and the information entered by the user.

If RetailCue's practices change in the future and personal information is shared with a third-party artificial-intelligence provider, we will update this Privacy Policy and provide any notice or consent required by applicable law or platform requirements before such processing occurs.

5. RetailCue Standard and Apple Subscriptions

RetailCue may offer paid subscription features through Apple's App Store.

If you purchase RetailCue Standard through Apple:

  • Apple processes the payment;
  • WAPPACK does not receive your complete payment-card number from Apple; and
  • RetailCue receives or verifies transaction and subscription information necessary to determine whether your subscription is active and to provide the appropriate RetailCue features.

Apple's handling of payment and Apple Account information is governed by Apple's own terms and privacy practices.

Deleting your RetailCue account does not automatically cancel an Apple subscription.

Apple subscriptions must be managed separately through your Apple Account or App Store subscription settings.

6. Service Providers and Sharing of Information

We may use third-party service providers to operate our websites, online stores, and digital products.

These providers may process information only as necessary to perform services for us.

Website and E-Commerce Providers

Our website and online-store operations may use providers including:

RetailCue Service Providers

RetailCue uses service providers including:

Supabase

Supabase provides infrastructure used for functions such as:

  • account authentication;
  • database and data storage;
  • backend processing; and
  • application services necessary to operate RetailCue.

Apple

Apple provides:

  • App Store application distribution;
  • StoreKit and in-app subscription processing;
  • purchase and subscription information necessary to verify RetailCue Standard access; and
  • related App Store services.

We expect and require service providers that process personal information on our behalf to protect that information appropriately and to provide protections consistent with applicable law and with the privacy protections described in this policy.

We may also disclose information where reasonably necessary to:

  • comply with applicable laws or regulations;
  • respond to lawful subpoenas, court orders, search warrants, or government requests;
  • protect the rights, property, or safety of WAPPACK, our users, or others;
  • investigate fraud, security incidents, or abuse; or
  • establish, exercise, or defend legal claims.

7. Sale of Personal Information and Advertising

WAPPACK does not sell RetailCue customer app information.

RetailCue does not use customer app information for:

  • third-party behavioral advertising;
  • cross-app advertising tracking; or
  • data-broker activities.

Information collected through the WAPPACK website or online store may be used for website analytics or marketing where permitted by law.

Where we use advertising or marketing technologies on our websites, users may have choices available through their browser, device settings, the applicable advertising platform, or applicable privacy-law mechanisms.

RetailCue app information is not used for those website advertising activities.

8. Cookies and Website Tracking Technologies

Our websites may use cookies and similar technologies to:

  • keep websites functioning;
  • remember preferences;
  • understand website traffic;
  • evaluate website performance;
  • prevent fraud; and
  • support marketing activities where applicable.

You can control or disable cookies through your browser settings. Disabling cookies may affect the functionality of some website features.

9. Do Not Track

Some browsers offer a “Do Not Track” signal.

Because there is not currently a universally accepted industry standard for responding to Do Not Track signals, our websites may not respond to all such signals.

Where applicable law requires us to recognize a particular browser-based privacy preference or opt-out mechanism, we will comply with that requirement.

10. Data Security

We use administrative, technical, and organizational safeguards designed to protect information against unauthorized access, alteration, disclosure, misuse, or destruction.

These safeguards may include access controls, authentication protections, secure service providers, and other measures appropriate to the nature of the information being handled.

No electronic transmission or storage system can guarantee absolute security.

Users are responsible for maintaining the confidentiality and security of their account credentials.

11. Data Retention

Website and Order Data

We may retain order, transaction, customer-service, and business records for as long as reasonably necessary to:

  • fulfill orders;
  • provide support;
  • maintain business and accounting records;
  • prevent fraud;
  • resolve disputes;
  • enforce agreements; and
  • comply with tax, accounting, legal, or regulatory requirements.

Where information is no longer reasonably necessary, we may delete or anonymize it, subject to applicable legal obligations.

RetailCue Data

We retain RetailCue account and workspace information while an account is active and for as long as reasonably necessary to:

  • provide RetailCue;
  • maintain account and service security;
  • resolve disputes;
  • prevent fraud or abuse;
  • enforce our agreements; and
  • comply with applicable legal obligations.

12. RetailCue Account Deletion

RetailCue users may initiate account deletion directly inside the application through:

Account → Danger Zone → Delete Account

When a deletion request is initiated, access to the RetailCue workspace is paused and RetailCue displays the applicable deletion deadline.

RetailCue currently provides a seven-calendar-day recovery period before the account becomes eligible for permanent deletion.

If you recover your account before the deletion deadline and before permanent deletion begins, account access may be restored.

After the deletion deadline, eligible RetailCue account and workspace information is permanently deleted through our deletion process, except for limited information that WAPPACK may be required or permitted to retain for purposes such as:

  • legal compliance;
  • security;
  • fraud prevention;
  • dispute resolution;
  • tax or accounting obligations; or
  • transaction and subscription records.

Account deletion does not automatically cancel an Apple App Store subscription. Apple subscriptions must be managed separately through Apple.

13. Your Privacy Choices and Rights

Depending on where you live, applicable privacy law may provide you with rights relating to your personal information, which may include the right to:

  • request access to personal information we maintain about you;
  • request correction of inaccurate information;
  • request deletion of eligible personal information;
  • object to or restrict certain processing;
  • withdraw consent where processing is based on consent; and
  • receive information about how personal information is used or disclosed.

These rights may be subject to exceptions under applicable law.

We may need to verify your identity before completing certain privacy requests.

RetailCue users may also use available in-app controls to manage their account, reset their password, or initiate account deletion.

14. International Processing

WAPPACK is based in the United States.

Information may be stored or processed in the United States or other countries where WAPPACK or its service providers operate.

Privacy and data-protection laws in those jurisdictions may differ from those in your country of residence.

Where required, we take appropriate steps to protect personal information transferred across jurisdictions.

15. Children and Minors

WAPPACK's services are not directed to children under the age of 13.

RetailCue is designed as a business and retail decision-support service and is not intended for use by children.

We do not knowingly collect personal information from children under 13 through RetailCue.

If you believe that a child has provided personal information to us in violation of applicable law, please contact us so that we can review and, where appropriate, delete the information.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to:

  • our services;
  • our privacy practices;
  • our service providers;
  • applicable laws or regulations; or
  • operational requirements.

When we make changes, we will update the Last Updated date at the top of this Privacy Policy.

If required by law, we will provide additional notice or obtain consent for material changes.
